1. Agreement to Terms

   These Terms of Service govern access to and use of www.le-vel.com and related websites, mobile applications, services, and purchases (collectively, the “Site”) operated by Le-Vel Brands, LLC (“Le-Vel,” “Company,” “we,” “us,” or “our”).

   By accessing the Site, purchasing products, enrolling as a customer, or enrolling as an independent Brand Promoter, you agree to be bound by these Terms and our separately posted Privacy Policy. If you do not agree, do not use the Site.

2. Direct Sales Model

   Le-Vel operates as a direct sales company. Products are sold directly to consumers through independent contractors known as Brand Promoters. Brand Promoters are independent contractors and not employees, agents, or partners of Le-Vel.

3. Eligibility

   You must be at least 18 years of age to enroll as a customer or Brand Promoter. By using the Site, you represent that you meet this requirement.

4. Product Purchases and Returns

   Retail Customer Returns

   Le-Vel offers a thirty (30) day return policy for Retail Customers on products purchased through authorized Brand Promoters.

   Unopened and undamaged products may be returned for a refund of the original purchase price less a 10 percent restocking fee.

   Opened, partially used, or damaged products may be refunded at 50 percent of the original purchase price.

   Shipping and handling charges are non-refundable.

   Refunds are issued to the original method of payment.

   Return Process for Online Orders

   Customers must notify Le-Vel Support through the online ticket system. Returned products must include proof of purchase. Customers are responsible for return shipping unless otherwise required by law.

   International return addresses may vary and are provided by Support upon request.

   Refunds are typically processed within approximately 10 business days after receipt and inspection.

   Brand Promoter Return/Repurchase Policy

   A Brand Promoter may request a refund for products purchased within thirty (30) days of the return request.

   A Brand Promoter may receive a refund on open or used products no more than once in any sixty (60) day period.

   More than one return within a sixty (60) day period will require the Brand Promoter to resign prior to processing an additional return.

   Refunds for open or used products will be issued at fifty percent (50%) of the original net cost paid, excluding shipping and handling.

   Unopened products in currently marketable and resalable condition will be repurchased at not less than ninety percent (90%) of the original net cost paid, excluding shipping and handling.

   Shipping and handling charges are not reimbursable.

   Any commissions paid on returned products will be reversed.

   Any orders refused at delivery will have outbound shipping costs deducted from the refund.

   All repurchases remain subject to compliance with the Seventy Percent Rule as set forth in the Policies and Procedures.

   The applicable return period may vary based on country or state law.

5. Buyers' Right to Cancel

   In compliance with the FTC Cooling-Off Rule and similar state laws, consumers may cancel certain qualifying sales within three (3) business days of purchase when applicable. Brand Promoters must comply with all cancellation notice requirements.

6. Exchanges

   Le-Vel does not offer product exchanges.

7. Promotional Credits

   Le-Vel Credits earned through promotional programs expire 120 days after issuance unless otherwise required by law and have no cash value.

8. Chargebacks

   Accounts associated with credit card chargebacks may be suspended. Reinstatement may require repayment of the chargeback amount, together with applicable processing fees.

   Fraudulent or abusive chargebacks may result in permanent termination.

9. Promotional Products

   If promotional products are retained when returning an order, their retail value will be deducted from the refund.

10. Product Disclaimer

    Statements regarding Le-Vel products have not been evaluated by the U.S. Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent any disease.

    Content, testimonials, and opinions are not medical advice. Consult a licensed healthcare provider before use, particularly if pregnant, nursing, taking medication, or under medical supervision.

11. Earnings Disclaimer

    Earnings by Brand Promoters vary. Success depends on individual effort, skill, leadership, compliance, and market conditions. No income is guaranteed. See the official Income Disclosure Statement for typical earnings data.

12. Resale Restrictions

    Products are intended for direct-to-consumer sales only. Customers and Brand Promoters may not resell products on Amazon, eBay, or any other third-party marketplace without prior written authorization. Violation may result in suspension or termination.

13. Account Suspension

    Le-Vel reserves the right to suspend or terminate accounts for violations of these Terms, Policies and Procedures, or applicable law.

14. Intellectual Property

    All trademarks, logos, branding, product names, and content are the property of Le-Vel Brands, LLC. Unauthorized use is prohibited.

15. SMS Terms

    By providing your mobile number and opting in, you consent to receive recurring SMS and MMS messages from Le-Vel in compliance with the Telephone Consumer Protection Act (TCPA), applicable FCC regulations, and A2P 10DLC requirements.

    Message frequency may vary. Message and data rates may apply.

    Consent is not required as a condition of purchase. Carriers are not liable for delayed or undelivered messages.

16. Transparency in Coverage

    In compliance with federal Transparency in Coverage regulations, machine-readable files are available through the link posted on the Site.

17. Limitation of Liability

    To the fullest extent permitted by law, Le-Vel shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or products.

    Total liability shall not exceed the amount paid by the user in the twelve months preceding the claim.

18. Arbitration and Dispute Resolution

    Except where prohibited by law, disputes shall be resolved through binding arbitration in accordance with the Federal Arbitration Act and the arbitration provisions contained in the Brand Promoter Agreement or customer terms, as applicable.

19. Governing Law

    These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

20. Changes to Terms

    Le-Vel may update these Terms at any time. Continued use of the Site constitutes acceptance of updated Terms.
